Appeals court rejects FCC's cable ownership cap

IDG News Service - A U.S. appeals court has struck down a U.S. Federal Communications Commission rule prohibiting any cable television operator from serving more than 30% of U.S. subscribers.

The U.S. District Court of Appeals for the District of Columbia Circuit ruled against the FCC today, potentially paving the way for large cable providers such as Comcast and Time Warner to buy up smaller competitors. The same court struck down a similar FCC rule back in 2001 and remanded the decision back to the agency.

The ownership cap didn't make sense in light of new cable competitors, including large telecom carriers, critics said.

"The court recognized that the 2007 analysis’ aging data and questionable assumptions sat oddly against the facts about new -- and successful -- competitors to cable systems in the multichannel video marketplace," FCC member Robert McDowell said in a statement. "It should go without saying that, in the future, outcomes in our proceedings should be driven by the facts and law, rather than the other way around.”

Comcast challenged the most recent cap, approved by the FCC in late 2007. “We are pleased the D.C. Circuit has vindicated our position," said Sena Fitzmaurice, Comcast's executive director for corporate communications and government affairs.

"This important decision affirms that rules must reflect the changing realities of the dynamic video marketplace, where today consumers have more choice in video providers and channels than ever before.”

FCC Chairman Julius Genachowski, who wasn't with the commission during the 2007 vote, noted that Congress in 1992 passed a law requiring ownership limits.

"The FCC staff is currently reviewing the court’s decision with respect to the limit previously adopted, and the commission will take this decision fully into account in future action to implement the law," Genachowski said in a statement

China will account for 15-20% of all iPhone sales in 2010, says analyst

Deal with China's No. 2 carrier makes sense because more of its customers are post-paid

Computerworld - Apple will sell somewhere between five and seven million iPhones in China in 2010 as a result of its deal with the country's second-largest mobile carrier, a Wall Street analyst said today.

The Chinese market will account for about 15% to 20% of Apple's worldwide iPhone sales next year, said Brian Marshall, an analyst with Broadpoint AmTech. "The upside for Apple is great."

Earlier today, China Unicom, the country's No. 2 carrier, announced a three-year agreement with Apple to sell the latter's iPhone, confirming rumors and reports that the two were nearing a deal. Last March, Web sites and bloggers reported that China Unicom had confirmed it would start selling the iPhone the following month, something that did not happen.

China Unicom has about 140 million subscribers, less than a third of the 460 million subscribers of China Mobile, the nation's largest mobile provider, said Marshall. Nonetheless, the No. 2 carrier in the country was still of interest to Apple, he added.

"What's interesting about China Unicom is that only about half of its subscribers are pre-paid customers, which is not the market that Apple is going after," said Marshall. "But about 80% of China Mobile's customers are pre-paid."

That put the two carriers on an almost-equal footing as far as Apple was concerned: China Unicom has about 70 million post-paid customers -- the kind that Apple wants - while China Mobile has approximately 92 million post-paid customers, Marshall estimated.

The close numbers "possibly" helped Apple make the decision to go with China Unicom, he said.

Another factor was that China Unicom has been aggressively building its 3G network, a necessity for the iPhone. China Unicom's 3G network, the only one of the three state-sanctioned carriers' that is compatible with the iPhone, will be in place by the end of the year, said the company's chairman and CEO, Chang Xiaobing, during a news conference today.

Under the three-year deal, China Unicom will start selling iPhones in the fourth quarter of this year. "With 70 million post-paid customers, and assuming flat sales, which are conservative, I think Apple will sell between five and seven million iPhones in China during 2010," said Marshall. He projects that Apple will sell 37 million iPhones worldwide in 2010.

"That means China will account for 15-20% of all iPhone sales next year," said Marshall, rounding up the actual numbers of 13.5-18.9% generated by his math.

Although neither China Unicom or Apple confirmed the reports, some media outlets, including the Wall Street Journal, said that the Chinese iPhone would lack Wi-Fi capabilities.

China Unicom did not spell out its iPhone pricing, but did say today that it will purchase the smartphones direct from Apple and offset some of the cost to customers by subsidizing part of the purchase price.

Nor did China Unicom say which model, or models, of the iPhone it will sell later this year.

Even so, Marshall was bullish on Apple's chances. "I see it as a big growth opportunity for Apple," he said.

Apple faces competition in China from other smartphones, including those built on Google's Android operating system, as well as BlackBerry devices from Research in Motion (RIM) and Palm's Pre. And China Mobile is working with Dell on mobile phone for the Chinese market.

On the Palm Pre front, China Telecom, the country's No. 3 mobile carrier by subscriber count, is in talks with Palm about offering that firm's newest smartphone in China.

Report: Wolfram Alpha to offer API for data feeds

Wolfram Alpha, the "computational knowledge engine" developed by Mathematica, will soon allow its dynamic search results to be queried and mashed up in a variety of new ways.

According to the Guardian, Wolfram will be opening its curated data to be queried via an application programming interface, or API. Currently, you can view results in a browser, export them as a PDF, or "play" them using a Mathematica plug-in. The ability to use the data on other sites and for other means, such as computations in spreadsheets, is appealing, if not earth-shattering.

Wolfram's launch fanfare was followed by much confusion about what Wolfram actually is. One thing that's clear is that the service has an impressive amount of data. What's not clear is if and when it will ever make money.

APIs are at least a good start in relation to monetization--holding the Alpha data captive within its site meant that it would never go beyond its own traffic, a recipe for disappointment and counter to the link economy that has been built around sites like Twitter.

In today's socialized Internet, APIs to your data are the barrier (or door) to getting users hooked on your data. Regardless of whether through an API that controls a cloud service like Amazon Simple Storage Service (S3), or the ability to get communications in and out of Facebook, users want to consume data in the way they feel most comfortable. Any company that creates or aggregates data needs to make it available, if it expects to ever hit critical mass.

CNET News' Tom Krazit recently wrote about a licensing deal between Microsoft's Bing "decision engine" and Wolfram Alpha (two non-search engines join up to create a super search engine?) that "allows Bing to present some of the specialized scientific and computational content that Wolfram Alpha generates."

If Microsoft is serious about taking on Google's geek factor, and asserting its dominant position in spreadsheets and higher education as Bing grows, then the data from Wolfram adds a new dimension. From the consumer perspective, the more informed the data is, the better, but both Bing and Alpha have a long way to go to catch up to Google.

Wi-Fi cell phones expected to double in two years

Analyst says WiFi has become a 'must have' item for millions of users

Computerworld - Global shipments of Wi-Fi-enabled cell phones are expected to double between 2009 and 2011, at least partially due to the emergence of a slew of smartphones with Wi-Fi capabilities, according to an analyst at ABI Research in New York.

Analyst Michael Morgan said he expects about 300 million handsets that provide dual wireless capability for cellular and Wi-Fi to ship during 2011, up from about 144 million expected to ship this year.

Morgan added that he expects about 85 million Wi-Fi-capable smartphones to ship globally this year -- of 170 million total smartphones. The Wi-Fi-capable smartphones include Apple Inc.'s iPhone and other popular offerings. Morgan noted that the number of smartphones shipped is expected to grow by about 20% each year for the next several years, and predicted that fully 90% will have Wi-Fi capability by 2014.

"A doubling of Wi-Fi enabled cell phones in two years is ridiculously high," Morgan said. "Wi-Fi has become a must-have item much as Bluetooth did earlier."

Part of the value of having a Wi-Fi handset these day is that the number of hot spots in coffee shops and other buildings is exploding while more and more homes and even planes support the technology, he noted. Eight U.S. Airlines now offer Wi-Fi access on more than 500 flights, with the number expected to grow to entire carrier fleets in two years.

Following AT&T's lead, Verizon Wireless recently made 30,000 Boingo Wireless Wi-Fi hot spots available to some 9 million of its residential customers on certain plans.

Morgan said Verizon is "warming up to Wi-Fi" and can be expected to support more smartphones and handsets with dual mode capability for Wi-Fi. Even AT&T was at first leery of Wi-Fi, fearing it would take traffic off from their cellular networks, Morgan said. But AT&T was "thrown into the [Wi-Fi] pool by the iPhone" after it first surfaced two years ago, he added.

Computer Aid ships its 150,000th PC to Fair Trade Banana Producers in Ecuador

Today Computer Aid shipped its 150,000th PC which is now on its way to Asoguabo, the Association of Small Banana Producers, in Ecuador. The producers grow and export bananas, including organic bananas, to the highest social and environmental standards. Products are exported with the FLO certification, accessing to fair trade markets.

Computer Aid’s 150,000th PC was shipped as part of a consignment of 540 computers and will be used by indigenous primary school children in one of the 17 schools in El Oro, Azuay, Guyas and Bolivar regions at the border with Peru where Asoguabo operates, or it will go to one of the Trade Unions of its affiliated members or be used for the day to day running of the banana producers association.

Bournemouth University have donated over 500 PCs to Computer Aid International. Their donated PCs have been sent to a number of projects including LinkNet Zambia, a cooperative organisation providing rural communications infrastructure and development in disadvantaged agricultural communities in Zambia.

Computer Aid added 400 Wi-Fi routers to the PCs donated by Bournemouth University so that LinkNet could further extend its mesh network, which provides internet connectivity to the hospital, malaria research institute, nurses’ training centre, schools and homes.

Farmers are using the internet to research the most suitable crops for the local climate and soil and successfully diversify their crops and increase income, nurses and doctors are studying online to increase their knowledge, and school children are receiving enhanced education at the local Macha Girls High School
